док.сокр. CISG межд. эк. Конвенция ООН о договорах международной купли-продажи товаров (принята в Вене 11 апреля 1980 г., вступила в силу 1 января 1988 г.; является одним из центральных международно-правовых актов в области коммерции, источником международного коммерческого права; применяется к договорам купли-продажи товаров между сторонами, коммерческие предприятия которых находятся в разных государствах: 1) когда эти государства являются договаривающимися государствами, 2) когда, согласно нормам международного частного права, применимо право договаривающегося государства; содержит базовые нормы касательно качества продаваемого товара, согласно которым продавец должен поставить товар, который по количеству, качеству и описанию соответствует требованиям договора и который затарирован или упакован так, как это требуется по договору; за исключением случаев, когда стороны договорились об ином, товар не соответствует договору, если он: 1) не пригоден для тех целей, для которых товар того же описания обычно используется; 2) не пригоден для любой конкретной цели, о которой продавец прямо или косвенно был поставлен в известность во время заключения договора, за исключением тех случаев, когда из обстоятельств следует, что покупатель не полагался или что для него было неразумным полагаться на компетентность или суждения продавца; 3) не обладает качествами товара, представленного продавцом покупателю в качестве образца или модели; 4) не затарирован или не упакован обычным для таких товаров способом, а при отсутствии такового — способом, который является надлежащим для сохранения и защиты данного товара; покупатель не несет ответственности на основании этих пунктов за любое несоответствие товара, если во время заключения договора покупатель знал или не мог не знать о таком несоответствии)Syn:Convention of Vienna 1980, Vienna Sales Convention 1980, United Nations Convention for the International Sale of Goods, United Nations Sales Convention, Vienna Convention on the International Sale of GoodsSee:Англо-русский экономический словарь > United Nations Convention on Contracts for the International Sale of Goods
